These Terms of Service ("Terms") govern your use of the CryptoKitt website, the CryptoProcessor plugin, and related services (collectively, the "Service") operated by CryptoKitt ("we", "us", or "our"). By using the Service, you agree to these Terms.
1. Description of Service
CryptoKitt provides a payment gateway plugin for WooCommerce that enables merchants to accept credit and debit card payments from customers, which are converted to Bitcoin through licensed third-party fiat on-ramp providers and settled via BTCPay Server. We are a technology provider and do not directly handle, hold, or transmit customer funds.
2. Eligibility
- You must be at least 18 years old to use the Service.
- You must comply with all applicable laws and regulations in your jurisdiction, including those related to cryptocurrency and financial transactions.
- You are responsible for ensuring that your use of cryptocurrency payments is legal in your jurisdiction.
3. Merchant Responsibilities
As a merchant using the CryptoProcessor plugin, you agree to:
- Provide accurate business and payment configuration information.
- Maintain the security of your API keys, BTCPay Server credentials, and WordPress installation.
- Comply with all applicable tax, consumer protection, and financial regulations.
- Clearly communicate payment terms and refund policies to your customers.
- Not use the Service for any unlawful purpose or to facilitate illegal transactions.
4. Payment Processing
- Fiat-to-cryptocurrency conversions are handled by third-party providers (such as ChangeNOW, Onramper, and similar providers) and are subject to their terms, fees, and verification requirements.
- Bitcoin transactions are irreversible once confirmed on the blockchain. Refunds must be handled separately between the merchant and customer.
- Cryptocurrency values are volatile. The amount of Bitcoin received may differ from the fiat value at the time of the customer's purchase due to exchange rate fluctuations during processing.
- We do not guarantee the availability, speed, or success of any payment transaction, as these depend on third-party services and the Bitcoin network.
5. Fees
CryptoKitt may charge fees for use of the Service. Third-party providers (fiat on-ramp partners, payment networks) apply their own fees. BTCPay Server is free and open-source software. Bitcoin network transaction fees apply to all on-chain transactions.
6. Intellectual Property
The CryptoProcessor plugin is licensed under the GPL-2.0-or-later license. The CryptoKitt name, logo, and website content are proprietary and may not be used without our written permission.
7. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any losses arising from cryptocurrency price volatility, failed transactions, third-party service outages, or unauthorized access to your systems.
- Our total liability to you for any claims arising from the Service shall not exceed the fees you paid to us in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless CryptoKitt and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
9. Prohibited Uses
You may not use the Service to:
- Process transactions for illegal goods or services
- Facilitate money laundering, terrorist financing, or sanctions evasion
- Engage in fraud or deceptive practices
- Violate any applicable laws or regulations
10. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service and uninstall the plugin at any time.
11. Modifications
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. Material changes will be communicated via the website or email.
12. Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law provisions.
